Rent-impairing violation

A violation on a state list of conditions serious enough that, unrepaired, tenants may deposit rent with the court instead of paying the owner.

Multiple Dwelling Law § 302-a keeps a list of conditions that constitute fire hazards or serious threats to life, health or safety. When a violation on that list stays unrepaired for six months, tenants can pay their rent into court rather than to the owner, and the owner cannot collect it until the condition is fixed.

HPD marks qualifying violations as rent-impairing in the public record, and this site counts them per code section.
